4.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our website solely for your personal, non-commercial use of our Services. This license does not permit you to:

Any feedback, suggestions, or ideas you provide to us about our Services may be used by us without obligation to compensate you. By providing such feedback, you assign to Dewey's Pizza all rights, title, and interest in and to such feedback.
5. Payment Terms
5.1 Pricing
All prices listed on our menu and website are in United States Dollars (USD) and are subject to applicable sales tax as required by federal, state, and local law. Prices are subject to change without prior notice. Any applicable delivery fees, service charges, or gratuities will be clearly disclosed at the time of ordering.
5.2 Payment Methods
We accept major credit cards, debit cards, and other payment methods as indicated on our website or at the point of sale. By providing your payment information, you authorize Dewey's Pizza to charge the total amount of your order, including applicable taxes and fees, to your designated payment method.
5.3 Order Confirmation
An order is not confirmed until you receive a confirmation notification from us. We reserve the right to cancel or refuse any order at our sole discretion, including but not limited to cases of suspected fraud, pricing errors, or product unavailability.
5.4 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final once an order has been prepared. If you experience an issue with your order — such as an incorrect item, quality concern, or delivery problem — please contact us immediately at [email protected]. We will evaluate each situation on a case-by-case basis and may offer a replacement, credit, or refund at our sole discretion.
5.5 Chargebacks
If you initiate a chargeback with your payment provider for a legitimate order that was fulfilled as described, we reserve the right to dispute the chargeback and may suspend or terminate your access to our Services. Fraudulent chargebacks may be referred to appropriate authorities.
5.6 Sales Tax
Dewey's Pizza collects and remits sales tax in accordance with applicable United States federal, state, and local tax laws. You are responsible for any applicable taxes, duties, or fees not collected by us that may apply to your purchase.
6. Food Safety, Allergen Information, and Nutritional Disclaimer
Dewey's Pizza takes food safety seriously and operates in compliance with applicable United States Food and Drug Administration (FDA) regulations and state and local health department requirements. However, please be aware of the following:
While we strive to provide accurate ingredient and allergen information, we do not guarantee that our menu descriptions are free from errors or that menu items will always be prepared identically. Nutritional information, where provided, is approximate and may vary based on portion size, preparation methods, and ingredient variations. We are not liable for adverse reactions resulting from undisclosed or unknown allergies.
7. Limitation of Liability
7.1 Exclusion of Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEWEY'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES OR THESE TERMS, INCLUDING BUT NOT LIMITED TO:

7.2 Cap on Liability
IN NO EVENT SHALL DEWEY'S PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
7.3 Essential Basis
The limitations of liability set forth in this Section reflect a reasonable allocation of risk and form an essential basis of the agreement between the parties. Dewey's Pizza would not have provided the Services without these limitations.
7.4 Jurisdictional Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain types of damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.
8. Disclaimers — Services Provided "As-Is"
8.1 No Warranties
THE SERVICES, INCLUDING OUR WEBSITE, ONLINE ORDERING SYSTEM, AND ALL CONTENT, ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEWEY'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties that the website will be uninterrupted, error-free, or free from viruses or harmful components;
- Warranties regarding the accuracy, reliability, completeness, or timeliness of any content on the website;
- Warranties that defects will be corrected.
8.2 Third-Party Services
Our website may contain links to or integrations with third-party websites, services, or platforms (such as delivery partners or payment processors). We do not control, endorse, or assume responsibility for third-party services. Your use of any third-party service is governed by that service's own terms and conditions and privacy policy.
8.3 Food Quality
While we strive to consistently deliver high-quality food products, we cannot guarantee that every item will meet your personal expectations or preferences. Food quality, taste, and appearance may vary based on ingredient availability, preparation conditions, and other factors.
9. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses — including reasonable attorneys' fees and court costs — arising out of or relating to:
- Your use of or access to our Services;
- Your violation of these Terms or any applicable law, regulation, or third-party right;
- Your User Content or any content you submit, post, or transmit through our Services;
- Your fraudulent, negligent, or willful misconduct;
- Any claim that your use of our Services caused damage to a third party;
- Your breach of any representations or warranties made under these Terms.
We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate fully with us in the defense of any such matter. This indemnification obligation will survive the termination of these Terms and your use of our Services.
10. Governing Law and Jurisdiction
10.1 Governing Law
These Terms of Service and any disputes arising out of or relating to these Terms, your use of our Services, or your relationship with Dewey's Pizza shall be governed by and construed in accordance with the laws of the United States of America and the applicable state law of the state in which Dewey's Pizza is registered and operating, without regard to its conflict of law principles.
10.2 Federal Consumer Protection
Your use of our Services and any commercial transactions conducted through our website are additionally subject to the Federal Trade Commission Act (FTC Act), 15 U.S.C. § 41 et seq., which prohibits unfair or deceptive acts or practices in commerce. Nothing in these Terms is intended to limit any rights you may have under applicable federal consumer protection laws.
10.3 California Residents
If you are a resident of California, you may have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), and other California-specific consumer protection statutes. Please refer to our Privacy Policy for details regarding your California privacy rights.
10.4 Jurisdiction and Venue
Subject to the arbitration provisions set forth in Section 11, you agree that any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts of competent jurisdiction in the United States, in the county or district where Dewey's Pizza principally operates. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to first contact Dewey's Pizza at [email protected] and attempt to resolve the dispute informally. We will make good-faith efforts to resolve any complaint or dispute within thirty (30) days of receiving written notice. This informal resolution process is a prerequisite to any formal dispute resolution.
11.2 Binding Arbitration
If informal resolution is unsuccessful, you and Dewey's Pizza agree that any dispute, controversy, or claim arising out of or relating to these Terms, the Services, or any transaction with Dewey's Pizza shall be resolved by binding arbitration, rather than in court, except as provided in Section 11.4 below. The arbitration shall be conducted by a recognized arbitration organization in accordance with its applicable commercial arbitration rules. The arbitration shall take place in a mutually agreed location or via remote proceedings.
11.3 Class Action Waiver
11.4 Exceptions to Arbitration
Notwithstanding the arbitration agreement above, either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm, including to protect intellectual property rights or confidential information. Small claims court actions within the applicable jurisdictional limits are also excluded from mandatory arbitration.
11.5 Arbitration Costs
The costs of arbitration shall be allocated in accordance with the rules of the applicable arbitration organization. Each party shall bear its own attorneys' fees unless the arbitrator determines otherwise based on applicable law.
12. Term and Termination
12.1 Term
These Terms are effective from the date you first access or use our Services and shall remain in full force and effect until terminated in accordance with this Section.
12.2 Termination by You
You may cease using our Services at any time. If you have created an account, you may request deletion of your account by contacting us at [email protected]. Termination of your account does not relieve you of any obligations incurred prior to termination, including any outstanding payment obligations.
12.3 Termination by Us
We reserve the right to suspend, restrict, or permanently terminate your access to our Services at any time, with or without notice, for any reason, including but not limited to:
- Your violation of these Terms or any applicable law;
- Fraudulent, abusive, or harmful conduct;
- Actions that may harm Dewey's Pizza, its employees, or other customers;
- At our sole discretion, for business reasons.
12.4 Effect of Termination
Upon termination of these Terms for any reason, the following provisions shall survive: intellectual property rights (Section 4), payment obligations (Section 5), limitation of liability (Section 7), indemnification (Section 9), governing law and jurisdiction (Section 10), dispute resolution (Section 11), and any other provisions that by their nature should survive termination.
13. Changes to Terms
Dewey's Pizza reserves the right to modify, update, or replace these Terms of Service at any time and for any reason. We will provide notice of material changes by:
- Posting the updated Terms on our website at deweyscafe.rest with a revised "Last Updated" date;
- Sending a notification to the email address associated with your account (if applicable);
- Displaying a prominent notice on our website homepage.
Changes to these Terms shall become effective immediately upon posting, unless we specify a later effective date. Your continued use of our Services after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of our Services.
We encourage you to review these Terms periodically to stay informed of any changes. The most current version of these Terms will always be available at deweyscafe.rest.
14. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction or arbitrator to be invalid, illegal, unenforceable, or contrary to applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions of these Terms shall remain in full force and effect and shall be interpreted and enforced to give maximum effect to the intentions of the parties as expressed herein.
The invalidity or unenforceability of any particular provision shall not affect the validity or enforceability of any other provision. The parties agree to negotiate in good faith a valid, enforceable replacement provision that most nearly reflects the original intent of the severed provision.
15. Additional Legal Provisions
15.1 Entire Agreement
These Terms of Service, together with our Privacy Policy and any other policies or agreements incorporated herein by reference, constitute the entire agreement between you and Dewey's Pizza with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, understandings, representations, and negotiations, whether oral or written, relating to such subject matter.
15.2 Waiver
No failure or delay by Dewey's Pizza in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof or the exercise of any other right, power, or privilege. A waiver of any breach or default under these Terms shall not constitute a waiver of any subsequent breach or default.
15.3 Assignment
You may not assign, transfer, or delegate your rights or obligations under these Terms without the prior written consent of Dewey's Pizza. We may freely assign, transfer, or delegate our rights and obligations under these Terms, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets. Any purported assignment in violation of this provision shall be null and void.
15.4 Force Majeure
Dewey's Pizza shall not be liable for any failure or delay in performance of our obligations under these Terms arising from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, governmental actions, power outages, internet service disruptions, supply chain issues, or other circumstances beyond our reasonable control. We will make reasonable efforts to notify you of such circumstances and to resume normal operations as soon as reasonably practicable.
15.5 No Third-Party Beneficiaries
These Terms are for the sole benefit of you and Dewey's Pizza and their respective successors and permitted assigns. Nothing in these Terms shall create or be deemed to create any rights in or for the benefit of any third party.
15.6 Headings
The section headings used in these Terms are for convenience only and have no legal or contractual effect. They shall not be used to interpret or construe the provisions of these Terms.
